These Terms of Use ("Terms") govern your access to and use of the ContactMeTag website, mobile applications, QR code tags, and related services (collectively, the "Services") operated by Spacinn Pty Ltd (ABN 42619718464) ("we", "us", or "our"). By accessing or using our Services you agree to be bound by these Terms. If you do not agree, please do not use our Services.
These Terms are governed by the laws of the Commonwealth of Australia, including the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)).
You must be at least 18 years of age, or have the consent of a parent or legal guardian, to purchase or activate a ContactMeTag product. By using the Services you represent that you meet this requirement.
ContactMeTag provides physical QR code tags (stickers, cards, keychains, and bracelets) that, when scanned, display a response page to call and message owner and his emergency contacts configured by the tag owner. We also provide a web-based platform to register, activate, and manage your tag information.
We make no guarantee that our Services will be available at all times without interruption. We reserve the right to modify, suspend, or discontinue any part of the Services at any time with reasonable notice where practicable.
When you activate a tag, you may be required to provide personal information including emergency contact details. You are responsible for ensuring that all information you provide is accurate and up to date. You must not register a tag with another person's contact information without their consent.
You agree not to:
All content, trademarks, logos, designs, software, and other intellectual property associated with the Services are owned by or licensed to Spacinn Pty Ltd and are protected under Australian intellectual property laws. You may not reproduce, distribute, or create derivative works from any part of the Services without our prior written consent.
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
To the maximum extent permitted by law, ContactMeTag's total liability to you for any claim arising out of or in connection with these Terms or the Services is limited to the amount you paid for the relevant product or service. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee under the Australian Consumer Law or any other applicable law that cannot be excluded, restricted, or modified.
ContactMeTag does not guarantee that scanning a QR code will always result in a successful contact being made. The Services are not a substitute for emergency services (dial 000 in Australia). We are not liable for any failure, delay, or error in communication arising from network conditions, device compatibility, or other factors outside our reasonable control.
You agree to indemnify and hold harmless ContactMeTag/Spacinn Pty Ltd., its officers, employees, and agents from any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising from your breach of these Terms or misuse of the Services, except to the extent that such liability cannot be limited under the Australian Consumer Law.
We may update these Terms from time to time. Updated Terms will be posted on this page with a revised "Last updated" date. Continued use of the Services after any changes constitutes acceptance of the updated Terms. Where material changes are made, we will endeavour to provide notice via email or through the Services.
These Terms are governed by the laws of the State of Victoria, Australia. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Victoria and the Federal Court of Australia, without prejudice to your right to bring proceedings in any other court of competent jurisdiction permitted under Australian law.
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
